The Security Council,


Reaffirming its resolutions 687 (1991), 699 (1991),707 (1991), 715 (1991), 1060 (1996), 1154 (1998) and 1284 (1999) and all other relevant resolutions and statements of its President, which establish the criteria for Iraqi compliance,

Reaffirming also its resolution 1382 (2001) and its intention to implement it fully,

Noting with grave concern the absence in Iraq of any international monitoring, inspection and verification body with regard to weapons of mass destruction and ballistic missiles since December 1998,

Commending the Secretary General and the Secretary General of the League of Arab States for their unrelenting efforts,

Taking note of the letter dated 16 September 2002 of the minister of foreign affairs of the Republic of Iraq (S/2002/1034) in which Iraq accepts the return of the United Nations weapons inspectors to Iraq without conditions,

Welcoming the efforts of the Executive. Chairman of UNMOVIC and the Director General of IAEA, and taking note of the agreement reached in Vienna on the practical arrangements necessary for the immediate resumption of inspections in accordance with the provisions of the relevant resolutions, on the basis of the proposals made by UNMOVIC and lAEA,

Underlying that the resumption of inspections by UNMOVIC and IAEA would be a first step towards a comprehensive settlement based on full implementation of all relevant resolutions of the Council, full compliance by Iraq of its obligations in the field of disarmament, and opening the way to ending the prohibitions referred to in Council's resolution 687,

Determined to secure full compliance with its relevant resolutions, in particular its resolutions 687 (1991) and 1284 (1999).

Recalling the objective of the establishment of a nuclear weapon-free zone in the region of the Middle East,

Reiterating the commitment of all Member States to the sovereignty, territorial integrity and political independence of Iraq, Kuwait and other neighbouring States,

Acting under Chapter VII of the Charter of the United Nations,

1. Demands that Iraq cooperate immediately, unconditionally and actively with the United Nations Monitoring, Verification and Inspection Commission (UNMOVIC) and the International Atomic Energy Agency (IAEA);

2. Reaffirms all the obligations of Iraq contained in all relevant resolutions and, in particular resolutions 687 (1991), 699 (1991), 707 (1991) and 715 (1991), 1051 (1996), 1154 (1998) and 1284 (1999) with regard to immediate, unconditional and unrestricted access in Iraq to any and all areas, facilities, equipments, records, means of transport which UNMOVIC and the IAEA wish to inspect as well as to all officials and other persons under the authority of the Iraqi Government whom UNMOVIC and the IAEA wish to interview so that both organs may fully discharge their mandate, and underlines that Iraq will be fully accountable for the safety of the teams of UNMOVIC and IAEA;

3. Endorses the letter dated 8 October 2002 from the Executive Chairman of UNMOVIC and the Director General of IAEA to General Al-Saadi of the Government of Iraq, which is annexed hereto and the practical arrangements contained therein;

4. Directs the Executive Chairman of UNMOVIC to improve the modalities necessary to ensure the full implementation of the provisions of the memorandum of understanding (S/1998/166) endorsed by the Security Council in its resolution 1154 (1998) so as to allow UNMOVIC and lAEA teams immediate, unconditional and unrestricted access as referred to in paragraph 2 above;

5. Demands that Iraq, in order to facilitate the establishment by UNMOVIC and IAEA of their work programme as referred to in Security Council's resolution 1284 (1999), provides without delay a complete, detailed and updated declaration on all its past programmes and remaining capacities to develop weapons of mass destruction and ballistic missiles with a range greater than 150 km;

6. Member States and in particular those with special capabilities in this field, to cooperate fully with UNMOVIC and lAEA by providing them any information related to prohibited programmes in accordance with the procedures developed by UNMOVIC in this area;

7. Supports the Secretary General in his ongoing efforts, in particular to ensure the implementation of this resolution, and expresses its full confidence in and support for IAEA and its Director General, and UNMOVIC and its Executive Chairman, in the discharge of their mandate with all necessary professionalism and strictness;

8. Confirms the full relevance of the goals of section D of resolution 1284 (1999) and its intention to act accordingly,

9. Directs the Executive Chairman of UNMOVIC and the Director General of lARA to report immediately to the Council any serious failure by Iraq to comply with its obligations referred to in paragraphs 2, 3 and 4 above;

10. Decides to convene immediately upon receipt of a report in accordance with paragraph 9 above, in order to consider the situation and the needed steps to ensure full compliance with relevant Security Council resolutions

11. Decides to remain seized of the matter.
