In 2003, "Janjaweed" militias backed by the Sudanese government began a murderous campaign against the African tribes in the Darfur region, which has left thousands of people dead, and at least 1.5 million people displaced from their homes. The rest of the world remained largely inactive to the horrors in Darfur until March 2005, when the UN Security Council, in an unprecedented move, referred the case of Darfur to the ICC. In April 2005, the UN submitted a list of 51 Sudanese suspects to the ICC. The ICC investigation revealed that many high-ranking Sudanese officials were involved in the crimes committed in Darfur. The ICC prosecutor has issued three arrest warrants for the leaders of the Sudanese government and the Janjaweed militia, including President Omar al-Bashir. All remain at large. The ICC has also submitted confidential requests for summons to appear for three Darfur rebel commanders, allegedly responsible for attacks on African Union peacekeepers.
The Sudanese government categorically denies the accusations and vows never to surrender any citizens to The Hague. It questions the ICC's jurisdiction and has proceeded with local justice initiatives, widely perceived to be "show trials" that do little to hold actual perpetrators accountable for the atrocities in Darfur. Many observers and Heads of State in the region question whether the ICC can succeed in the difficult task of establishing peace through justice in the Sudan. The Arab League and the African league asked the Security Council to suspend prosecutions in favor of the ongoing efforts for peace in the Sudan region. These efforts to suspend the ICC activities did not succeed. In July 2009, the African Union announced that it would not cooperate with the ICC in arresting al-Bashir.

Violating the international warrant for his arrest, Sudan's President Omar al-Bashir has travelled to an ICC member state-Chad. Human rights activists are calling on Chad to live up to its obligations as a member state of the ICC and detain al-Bashir, but officials in Chad say they will treat the Sudanese president "with dignity and with respect." Chadian Ambassador Bechir says the country is more loyal to the African Union, which passed a resolution encouraging members to not turn over al-Bashir, than they are to the ICC. The US has criticized Chad for its inaction, but, as the US is not an ICC member, many question the country's commitment to international justice. (NPR)
On August 27, 2009, the International Criminal Court summoned the Sudan rebel leaders Abdallah Banda Abakaer and Saleh Mohammed Jerbo Jamus to appear before the Court for alleged war crimes offences. Both are believed to be responsible for the attack against the African Union Mission in Sudan (AMIS) in 2007, leaving 12 AMIS soldiers dead. On June 16, 2010, both rebel leaders turned themselves in to the ICC. Sudan's President Omar al-Bashir, who is also wanted for alleged war crimes, continues to deny the charges against him. Sudanese President Omar al-Bashir recently declared that the International Criminal Court has done him a favour by issuing a warrant for his arrest. Recent developments seem to indicate that Bashir's popularity has increased since the arrest-warrant. The African Union, the League of Arab States, and members of the Islamic Conference have declared that they will not cooperate with the ICC in arresting him. In addition, he received an invitation from Venezuela and is promised a visit by South African President Jacob Zuma. He is also involved in the ongoing peace process with Darfur's largest rebel group, the Justice and Equality Movement. On 8 February 2010, the Pre-Trial Chamber of the International Criminal Court (ICC) ruled in favor of Sudanese rebel leader, Bahar Idriss Abu Garda, by dropping the charges against him. The judges decided that the evidence presented by the prosecutors was insufficient to hold the rebel leader responsible for the war crimes committed against African Union peacekeepers in north Darfur. The Appeals Chamber of the International Criminal Court (ICC) has unanimously reversed the decision of the ICC's Pre-Trial Chamber not to include the crime of genocide in the arrest warrant against President Omar al-Bashir of Sudan. This means that the Pre-Trial chamber must re-examine whether the arrest warrant, which includes charges of crimes against humanity and war crimes, should be extended to cover the crime of genocide. As Sudan prepares for its first nationwide multi- party elections in decades, tensions are building across the country. At the same time, the ICC is pursuing its investigation into the violence in Sudan. Many observers suggest that the ICC inquiries heighten tensions and scupper peace plans, and so propose the Security Council suspend the investigation. Here, French Ambassador Gerard Araud insists there is no contradiction between peace and justice - for combating impunity is one of the conditions for lasting peace.

Bashir faces crimes against humanity, genocide and war crimes. Leaders from China, the Arab League and the African Union (AU) have opposed this indictment. The NGO Waging Peace has submitted strong evidence of the Sudanese violence on Darfur civilians to the ICC. Drawings by children of victim mothers depict the Sudanese army and Arab Janjaweed militia waging attacks on civilians, as well as bombings, mass graves and people dying in puddles of blood. Rebecca Tinsley, Director of Waging Peace, urges the ICC to consider this striking evidence saying, "If this is not evidence, I don't know what is." Human Rights Watch accuses the Special Criminal Court on the Events in Darfur, a Sudanese national court, of being a failure and calls on Khartoum to "hand over suspects indicted by the ICC." In 2006, the national court only tried low-ranking officials charged with minor offences and even granted amnesty to two members of the Sudanese Military Intelligence convicted for murder. A year after issuing 100 warrants, the national court has only executed 10 of them. Sudan claims that it will try all the cases but it has not shown any signs of keeping its promise.

International Criminal Court prosecutors intend to secure arrest warrants for individuals suspected of backing the Janjaweed militias' murderous campaign against African tribes in Darfur by February 2007, reports Reuters. Chief Prosecutor Luis Moreno-Ocampo and his team will likely present, as part of their evidence, a yet-to-be-published UN list of Sudanese suspects – some, reportedly high-ranking officials. Though the ICC has indicted fewer suspects than other international crimes tribunals, Richard Dicker of Human Rights Watch says "an arrest warrant by itself sends a powerful signal."
Against the backdrop of high security risks and the apparent lack of government cooperation, the International Criminal Court has struggled to investigate crimes against humanity in Darfur, Sudan. The Sudanese government continues to refuse to cooperate with the International Criminal Court (ICC), instructed by the Security Council to investigate the Darfur situation. UN Expert Juan Mendez stresses that the Sudanese government is not making good on its promise to hold human rights violators accountable, doing nothing about major crimes that have occurred. The Sudanese government maintains its opposition to the ICC investigations in the Darfur region of Sudan.
