Zur Stärkung unternehmerischer Verantwortung entlang von Liefer- und Wertschöpfungsketten wird national und international vielfach auf sogenannte Multi-Stakeholder-Initiativen (MSI) gesetzt. Zuletzt kündigte das Bundesministerium für Arbeit und Soziales (BMAS) an, sich im Rahmen der deutschen EU-Ratspräsidentschaft verstärkt für EU-weite Branchendialoge einsetzen zu wollen (CorA-Netzwerk et al.).

Heute werden die Bundesminister Gerd Müller und Hubertus Heil die Ergebnisse der Umfrage der Bundesregierung zur Einhaltung der Menschenrechte entlang globaler Lieferketten vorstellen. Es ist zu befürchten, dass diese nicht gut ausfallen und ein Großteil der deutschen Unternehmen Menschenrechte missachtet. Ein Lieferkettengesetz wird damit unumgänglich. Es muss auch geschlechtergerecht sein. Das fordert ein Bündnis von 12 Entwicklungs- und Menschenrechtsorganisationen in seinem aktuellen Positionspapier. In globalen Wertschöpfungsketten sind Frauen vielfach benachteiligt und größeren Risiken ausgesetzt als Männer. Die Bandbreite reicht von sexueller Belästigung am Arbeitsplatz über Arbeitsbedingungen, die keine Rücksicht auf die Sorgearbeit von Frauen nehmen bis hin zu ungleicher Bezahlung (GPF et al.)

Corporate Europe Observatory has set up Corona Lobby Watch, in order to ensure that civil society can continue to monitor the moves of 'Coronawashing' lobbyists (CSO).

The unprecedented outbreak of the new coronavirus once again places the WHO at the centre of global public action for health. Independent global health experts in countries around the world have highlighted the importance of the WHO in the response to this global public health crisis both in terms of transparency and timeliness of recommendations and decisions. This is no small feat given heavy critique of its handling of the Ebola Crisis in West Africa in 2014/15, the H1N1 Influenza Pandemic in 2009, and the SARS outbreak of 2003. It shows that this unique UN Organization has taken a big step forward in the performance as the coordinating agency in global health. US President Donald Trump’s serious accusations, disgraceful campaigning and threats of withholding WHO funding can only be understood as a blame-game by a government that scapegoats others for its own lack of responsibility and failure to prevent and manage the crisis. In a joint letter, members of the Geneva Global Health Hub condemn this tirade against WHO as baseless and unacceptable, particularly in such a critical situation that requires solidarity (G2H2).

"There is a very real threat of a rapidly moving, highly lethal pandemic of a respiratory pathogen killing 50 to 80 million people and wiping out nearly 5% of the world’s economy. A global pandemic on that scale would be catastrophic, creating widespread havoc, instability and insecurity.” In his new article by the coordinator of Social Watch, Roberto Bissio points out that as early as September 2019, the Global Preparedness Monitoring Board published a report entitled A World at Risk conclusively highlighting that the world is not prepared for an impending catastrophic pandemic. Bissio argues that the emphasis of the Global Preparedness Report on public health services is particularly striking if it is noted that both the World Bank – co-sponsor of the Board – and the Gates Foundation, represented on the Board have been active advocates of public-private partnerships in health (PPPs) and have undermined universal public services. They favoured instead focused attention on the poorest and on specific diseases, such as Malaria or Ebola, but at the cost of the dismantling of generic health systems. The Board itself recognized in its 2019 Report that “entities providing funding and programmatic support for countries, such as the Global Fund to Fight AIDS, TB and Malaria (Global Fund) and Gavi, do not explicitly include prevention and preparedness to achieve broader health security.” The lack of foresight in the face of the announced pandemic is now forcing governments around the world to resort to extreme and innovative sanitary measures, but the looming debt crisis is now also calling for foresight, leadership and innovation (Social Watch).

Am heutigen Donnerstag wird der Bericht der fünften Tagung der zwischenstaatlichen Arbeitsgruppe zu einem verbindlichen Abkommen für Wirtschaft und Menschenrechte dem UN-Menschenrechtsrat vorgelegt. Die Staaten waren dazu aufgerufen, den aktuellen Abkommensentwurf bis Ende Februar 2020 schriftlich zu kommentieren. Aus diesem Anlass fordert Karolin Seitz, Koordinatorin des zivilgesellschaftlichen Bündnisses Treaty Alliance Deutschland in einem Pressestatement, dass sich Deutschland nach fünf Jahren Schweigen endlich auch zu dem UN-Abkommen positioniert und sich für ein Verhandlungsmandat für die EU einsetzt (Treaty Alliance Deutschland/ GPF).

ECCJ and others welcome the release of the findings from the European Commission’s study on due diligence requirements through the supply chain. The results of European Commission's study unequivocally affirm that voluntary measures are failing and that there is urgent need for regulatory action at EU level in order to protect workers, communities, and the environment from systematic, ongoing and worsening human rights and environmental impacts linked to the global supply chains of businesses and financial institutions. Already in December 2019, more than 100 civil society organisations have called for EU human rights and environmental due diligence legislation to implement the UN Guiding Principles on Business and Human Rights (ECCJ et al.)

In December 2019, it was officially announced that the UN Headquarter would be hosting a Food Systems Summit in 2021 with the aim of maximizing the benefits of a food systems approach across the entire 2030 Agenda, meeting the challenges of climate change, making food systems inclusive, and supporting sustainable peace. The small-scale food producers’ organizations and other civil society organizations concerned with food, recognize the importance and timeliness of this Summit, but at the same time they have grave concerns: The Summit is not building on the legacy of the past world food summits, which were clearly anchored in the FAO and resulted in the creation of innovative, inclusive and participatory governance mechanisms with the goal of realizing the right to adequate food for all. Further, the appointment of Ms. Agnes Kalibata, the current President of the Alliance for a Green Revolution in Africa (AGRA) as Special Envoy for the Summit presents a clear conflict of interest with regards to the stated purpose of the Summit. NGOs and social movements that since 1996 are involved in participatory mechanisms in the FAO, CFS, IFAD and other UN processes are looking to this process as very dangerous for the democratic and multilateral food governance. For these reasons the CSOs are writing now jointly a letter to address all the concerns to the United Nations Secretary-General Mr. António Guterres.

Im Jahr 2016 hat die Bundesregierung den „Nationalen Aktionsplan Wirtschaft und Menschenrechte“ (NAP) verabschiedet, um die Einhaltung von Menschenrechten entlang der Lieferketten deutscher Unternehmen durchzusetzen. Der NAP beruht jedoch vollständig auf freiwilligen Maßnahmen von Unternehmen: Verbindliche Regeln hatte die Bundesregierung auf Druck von Unternehmensverbänden aus dem NAP gestrichen. Die vorliegende Recherche zeigt, dass dieser Lobbydruck seither nicht nachgelassen hat. Im Gegenteil: Wirtschaftsverbände versuchen aktiv, auch die im Herbst 2018 gestartete Überprüfung der menschenrechtlichen Sorgfalt deutscher Unternehmen zu verzögern und zu verwässern. Die Bundesregierung möchte dieses sogenannte „NAP-Monitoring“ zur Entscheidungsgrundlage nehmen, ob sie ein Lieferkettengesetz einführt oder nicht. Für die vorliegende Recherche haben Brot für die Welt, Global Policy Forum und MISEREOR sechs Anfragen nach dem Informationsfreiheitsgesetz (IFG) gestellt, unter anderem an das Auswärtige Amt (AA), das Bundesministerium für Wirtschaft und Energie (BMWi) und an das Bundesministerium für wirtschaftliche Zusammenarbeit und Entwicklung (BMZ). Darin wurden Information zu Treffen und schriftlichem Austausch der Ministerien mit Unternehmen und Wirtschaftsverbänden zu den Themen „NAP-Monitoring“ und „Lieferkettengesetz“ angefragt. Die Auswertung der Dokumente zeigt: Eine wichtige Rolle in der Lobbyoffensive spielte Steffen Kampeter, Hauptgeschäftsführer der Bundesvereinigung der Deutschen Arbeitgeberverbände (BDA), der bis 2015 noch Staatssekretär im Bundesfinanzministerium (BMF) war und daher über beste Kontakte zum Bundeswirtschaftsminister Peter Altmaier und zum Bundeskanzleramt verfügt. Unter massiven Druck geriet auch der Bundesentwicklungsminister Gerd Müller, nachdem im Februar 2019 der Entwurf aus seinem Ministerium für ein Wertschöpfungskettengesetz an die Öffentlichkeit gelangt war. Brot für die Welt, Global Policy Forum und MISEREOR haben sich der „Initiative Lieferkettengesetz“ angeschlossen und fordern von der Bundesregierung die Einführung verbindlicher Regeln für Unternehmen - unabhängig von dem auf Druck der Wirtschaftslobby stark verwässerten NAP-Monitoring (Brot für die Welt, Global Policy Forum, MISEREOR).

In its final oral statement during the UN negotiations on a Treaty on Business and Human Rights, a coalition of ten civil society organisations restate their support and engagement in the process towards a Legally Binding Instrument. They reaffirm their view that the revised draft provides a solid basis for further negotiations by recognizing the fundamental challenges created by today’s transnational business activities and corporate structures, and has moved on from the former draft in important respects such as effective remedy and reparation for persons affected by human rights violations. Most importantly, the session has shown that there exist concrete proposals and solutions on how to clarify the remaining issues. In order to keep a steady pace of negotiations and to further advance the Treaty Process, the coalition requests that talks continue on an intersessional basis until the next formal session of the Working Group in October 2020, taking into account the contributions of civil society actors and other experts (Global Policy Forum et al.).

Abschluss der 5. Verhandlungsrunde über ein UN-Abkommen zu Wirtschaft und Menschenrechten - Bericht

Nach fünf Verhandlungstagen schlossen die Verhandlungen der zwischenstaatlichen Arbeitsgruppe zu einem verbindlichen UN-Abkommen zu Wirtschaft und Menschenrechte am 18. Oktober 2019 mit der Annahme des Verhandlungsberichts und mit Beschlüssen über den weiteren Verlauf des Prozesses. Am Morgen wurden die letzten Artikel (Artikel 14-22) des Abkommensentwurfs diskutiert, die sich insbesondere mit dem Inkrafttreten und der Umsetzung des zukünftigen Abkommens befassen. Da diese Artikel bei der letzten Verhandlungsrunde im Oktober 2018 kaum diskutiert worden waren, wurden hinsichtlich des neuen Abkommensentwurfs („Revised Draft“) kaum Änderungen gegenüber dem vorherigen Entwurf („Zero Draft“) vorgenommen, so der ecuadorianische Vorsitzende der zwischenstaatlichen Arbeitsgruppe (Global Policy Forum).

Auch am vierten Tag gab es wieder zwei Verhandlungsrunden. Am Morgen wurde neben den Artikeln zur justiziellen Zusammenarbeit der Staaten (Artikel 10) und internationalen Kooperation bei der Umsetzung des Abkommens (Artikel 11) der Artikel zur Vereinbarkeit des UN-Abkommens mit anderen völkerrechtlichen Verträgen diskutiert (Artikel 12). Insbesondere das letzte Thema birgt einiges an Sprengkraft, da es in diesem Artikel unter anderem um das Verhältnis von Handels- und Investitionsabkommen mit einem zukünftigen UN-Abkommen zu Wirtschaft und Menschenrechten geht. In den sogenannten „Elements“ von 2017 war noch klar formuliert worden, dass menschenrechtliche Verpflichtungen, die sich aus einem zukünftigen UN-Abkommen ergeben, Vorrang vor Handels- und Investitionsabkommen haben sollten. Der Vertragsentwurf aus diesem Jahr („Revised Draft“) hingegen ist nicht ganz eindeutig darin, ob bestehende und zukünftige völkerrechtliche Verträge wie zum Beispiel Handelsabkommen dem UN-Abkommen rechtlich widersprechen dürfen (BUND).

Am 16. Oktober begann der dritte Tag der Verhandlungen der UN-Working Group on Business and Human Rightsüber ein „Binding Treaty“. Im Zentrum standen Artikel 6-9 des Entwurfs. Diese seien als verbindliche Haftungsregeln „Herz des Vertrages“. So die Delegierten Brasiliens, Ägyptens und Chinas, sowie der geladene Experte, Prof. Olivier De Schutter. Am dritten Tag der Verhandlungen wurde deutlich, dass der Treaty in Sachen Haftung noch verbesserungswürdig ist. Insbesondere an der Beschränkung auf vertragliche Beziehungen, die Unklarheit, ob zivil- oder strafrechtliche Haftung gemeint ist und der Einfügung einer Notzuständigkeit lässt sich noch arbeiten. Viele dieser Fragen sind auf EU-Ebene bereits im Rahmen der Brüssel- und Rom-Verordnungen geklärt. Umso bedauerlicher ist es, dass die EU während dieses Verhandlungstages weitestgehend auf stumm schaltete. Dies hinderte jedoch Mitgliedsstaaten nicht daran, sich an den Verhandlungen zu beteiligen. Frankreich, Belgien und auch Spanien nahmen teil (Attac Deutschland).

In its oral statement during the UN negotiations on a Treaty on Business and Human Rights, Treaty Alliance Germany, consisting of 27 civil society organisations welcomes the improvements achieved with the Revised Draft, especially that it places a special focus on improved access to justice and remedies for those affected by human rights violations or environmental destruction. It expresses its regrets that after four sessions of the working group, the EU still has not resolved the question of the mandate and is not engaging constructively in this process. This is particularly true since there is currently a strong momentum in the EU for human rights due diligence legislation. Therefore, it should be of particular interest to the EU and its member states to constructivelyncontribute to the historic chance to establish an international “level playing field” regarding mandatory human rights due diligence and to ensure the successful continuation of the treaty process. In this regard, Germany should not hide behind the EU and engage actively in the process (Treaty Alliance Germany).

Declaration of Civil Society Organisations at the World Bank and IMF Annual Meetings

In a joint declaration, 35 civil society organisations reject the IMF austerity policies implemented in Ecuador, Argentina and Haiti, with agreements that include the restriction of public investment, reduction of labor rights, establish tax amnesties for the corporate sector and trigger a continued deterioration in public services. This is not the way to either prevent or resolve a crisis. The IMF has to change its austerity and deregulatory structural reform policies. Countries must have access to financing with sovereignty over their economic policies and in a a way that the State can guarantee human rights, civil and political, as well as economic and social rights, in line with their Constitutions and international treaties, and with the participation of diverse sectors of society, including social movements of indigenous people, women and workers (GPF et al.).

Während sich die Bundesregierung weiter dahinter versteckt, dass die Frage des EU-Verhandlungsmandats noch nicht geklärt ist und man sich nur im Block mit der EU äußern werde, war der zweite Verhandlungstag durch Beiträge von Spanien und Frankreich geprägt, für die diese Beschränkungen anscheinend nicht gelten. Inhaltlich ging es am zweiten Tag um die wichtigen Themen des Anwendungsbereiches eines zukünftigen Abkommens, die Frage, welche Rechte Betroffene von wirtschaftsbezogenen Menschenrechtsverletzungen haben und welche Maßnahmen Staaten als auch Unternehmen ergreifen müssen, um Schäden zu verhindern. Es zeigte sich erneut, dass Staaten, die auf nationaler Ebene ihre Verantwortung wahrnehmen und Unternehmen zur Beachtung menschenrechtlicher Sorgfalt verpflichten, auch auf internationaler Ebene voranschreiten (Brot für die Welt).

In Genf haben am 14. Oktober die Verhandlungen über den Entwurf eines UN-Abkommens für Wirtschaft und Menschenrechte begonnen. Laut Entwurf müssen Staaten die Unternehmen gesetzlich zur Achtung von Menschenrechten im In- und Ausland verpflichten sowie Betroffenen von Menschenrechtsverletzungen den Zugang zu Gerichten erleichtern: eine historische Chance, den Vorrang von Menschenrechten vor Profitinteressen in der globalisierten Wirtschaft völkerrechtlich festzuschreiben (MISEREOR).

Protests on the streets of the Ecuadorian capital Quito erupted in the beginning of October 2019 following the abandonment of state subsidies on the price of gasoline and diesel. The cutbacks are part of structural reform conditionalities that secured the government of Lenín Moreno a loan of US$ 4.2 billion by the International Monetary Fund (IMF). These conditionalities are very likely to contribute to the worsening of the social situation in the country. The uprisings should therefore also steer the view towards the role of the IMF, its loan policies and subsequent social effects thereof (Global Policy Forum).

Opening Statement of the Treaty Alliance: Time for constructive engagement from the EU and Member States on the content of the Revised Draft of the Binding Treaty

59 member organizations of the Treaty Alliance demand in their joint opening statement for the upcoming negotiation round in Geneva constructive engagement from the EU and Member States on the content of the Revised Darft of the Binding Treaty. More than ever, citizens are mobilizing for action to stop climate change and corporate activities damaging our shared environment, health and future. Fires in the Amazon point to complicity of mining, agribusiness and the food industry in demand and supply of products and materials causing deforestation and violence against human rights defenders and indigenous peoples. These events show why an international agreement is needed to respond to the harm that transnational corporations and global value chains can cause, and to address the insufficient regulation by national governments of transnational corporate activity. The Inter-Governmental Working Group (IGWG) gives us a timely opportunity to make progress with a legal instrument at the international level which can complement and reinforce national and regional rules, such as with the multiple developments regarding mandatory human rights and environmental due diligence (Treaty Alliance).

On the basis of in-depth consultations with governments, researchers and civil society, the Ecuadorian Chairman Emilio Rafael Izquierdo Miño published a consolidated draft agreement (»Revised Draft«) in July 2019. This document will serve as the basis for "substantive negotiations" during the upcoming fifth session of the working group, to be held in Geneva from 14 to 18 October 2019. In its new statement the Treaty Alliance Germany communicates its views on the provisions contained in the Revised Draft (Treaty Alliance Germany).

Extractive Industries and Violation of Women’s Rights: Between partnerships and regulation – two diverging ways to tackle the problem at the UN

From October 14 to 18, 2019, the intergovernmental working group to elaborate a binding instrument to regulate transnational business enterprises and other business enterprises with respect to human rights (OEIGWG) will convene for the 5thtime in the UN Human Rights Council in Geneva. The new briefing paper “Extractive Industries and Women’s Rights: Between partnerships and regulation – two diverging ways to tackle the problem at the UN”, published by AWID, DAWN, Global Policy Forum and Rosa-Luxemburg-Stiftung presents how women are disproportionately affected by negative social and environmental impacts of extractive industries. The briefing also explains why a new partnership between UN Women and BHP Billiton, launched in June 2018, is very problematic. Similar to UN Women, other United Nations (UN) entities are trying to attract partnerships with the corporate sector. As the case of UN Women shows, potential risks and side-effects of such partnerships are often not properly addressed. These risks should also be considered in the preparation of the 64th session of the Commission on the Status of Women and the 25th Anniversary of the Beijing Declaration commemorative events in 2020. Corporate involvement in these events should only play a limited role (AWID, DAWN, GPF, RLS).

Am 14. Oktober beginnt in Genf die fünfte Verhandlungsrunde für ein UN-Abkommen zu Wirtschaft und Menschenrechten. Deutschland hat bereits angekündigt, sich an den aktuellen Verhandlungen nicht inhaltlich zu beteiligen. Aus diesem Grund fordert die Treaty Alliance Deutschland – ein breites Bündnis aus 27 zivilgesellschaftlichen Organisationen – die Bundesregierung und die EU auf, die Blockade zu beenden und tätig zu werden. On Wednesday, 25 September 2019, Heads of State and Government will meet at the United Nations (UN) headquarter in New York to discuss establishing further partnerships, in particular with the private sector, as a means of implementing the 2030 Agenda and its 17 Sustainable Development Goals (SDGs). Global multi-stakeholder partnerships between public and private actors, which move beyond traditional nation-state multilateralism, are now perceived as the future of international cooperation. The UN is already involved in hundreds of partnership initiatives with individual companies and business associations. “Rules of engagement between the UN and private actors", the new working paper by Brot für die Welt, Global Policy Forum and MISEREOR, demonstrates that with just the existing guidelines, which are weak and highly heterogeneous, effective and comprehensive rules for such cooperation are still missing. The non-regulated engagement between the UN and the private sector represents a major risk for the UN and for realising the SDGs.The UN needs to urgently develop an effective legal and institutional framework for its relations with the private sector (Brot für die Welt, Global Policy Forum, MISEREOR).

Globale Multi-Stakeholder-Partnerschaften und Initiativen zwischen öffentlichen und privaten Akteuren werden seit Jahren als die Zukunft der internationalen Zusammenarbeit betrachtet. Mit der Verabschiedung der Agenda 2030 und ihrer 17 Ziele für nachhaltige Entwicklung (SDGs) im September 2015 hat sich dieser Trend beschleunigt. Das vertiefte Engagement der UN mit der Wirtschaft beinhaltet jedoch zahlreiche Risiken. Viele UN-Sonderorganisationen, -Fonds und -Programme haben Prozesse zur Festlegung neuer Regeln für die Zusammenarbeit mit der Wirtschaft gestartet. Aber ein gemeinsamer und systemischer Ansatz, der zu einem umfassenden Rechtsrahmen für die Beziehungen zwischen der UN und dem Privatsektor führen soll, lässt auf sich warten. Wie ein neues Arbeitspapier von Global Policy Frorum, Brot für die Welt und MISEREOR zeigt, sind die bestehenden Leitlinien stark heterogen und werden nur hinreichend umgesetzt. Deutschland sollte sich daher zügig für einen wirksamen rechtlichen und institutionellen Rahmen bei der UN einsetzen (Brot für die Welt, Global Policy Forum, MISEREOR).

Auf Grundlage intensiver Konsultationen mit Regierungen, Wissenschaft und Zivilgesellschaft hat der ecuadorianische Vorsitzende Emilio Rafael Izquierdo Miño im Juli 2019 einen konsolidierten Entwurf eines UN-Abkommens zu Wirtschaft und Menschenrechte veröffentlicht („Revised Draft“). Während der fünften Tagung der UN-Arbeitsgruppe vom 14. bis 18. Oktober 2019 in Genf wird dieser die Grundlage für „substantielle Verhandlungen“ sein. Die Treaty Alliance Deutschland bezieht in einem neuen Positionspapier Stellung zum neuen Entwurf (Treaty Alliance Deutschland).

Imagine an environmentally or socially destructive corporate project – say, a toxic mine, which could poison your local supply of water, or a luxury real estate project, which would displace hundreds of people in its neighbourhood. You and your community oppose the plans, the courts judge in your favour and the project is stopped. Seems like a community victory right? But then, the company behind the project sues your country for interfering with its profits, demanding millions or even billions in compensation, including for future profits. Actually, you do not need to imagine all this. It is the reality. The ISDS parallel justice system for big business is again and again used as a corporate weapon against the public interest. In a new report by Friends of the Earth Europe and International, the Transnational Institute (TNI) and Corporate Europe Observatory (CEO), the organizations present 10 recent cases from around the world that show how the red carpet courts continue to thrive and reinforce injustice across the world (Friends of the Earth Europe and International, the Transnational Institute Corporate Europe Observatory).

A global corporate and government marriage took place mid June 2019 – and governments and citizens were not even invited as guests. The occasion was the signing of a memorandum of understanding between the corporate-led World Economic Forum (WEF) and the United Nations. The nuptial agreement commits the two institutions to unprecedented levels of cooperation and coordination in the fields of education, women, financing, climate change, and health. At first glance, this agreement may sound entirely beneficial. Harris Gleckman, senior fellow at the Center for Governance and Sustainability at the University of Massachusetts Boston and Director of Benchmark Environmental Consulting warns in this article that the memorandum is not just about cooperation, but rather establishes an institutional home for multinational corporations inside the UN. There is no similar space in the UN system for civil society, for academics, for religious leaders, or for youth. In its strong advocacy for a “multistakeholder” approach to global governance which demotes the primacy of states to make global decisions, it also marks a fundamental challenge to a nation-state global governance system that - despite its flaws - has clear obligations, responsibilities and liabilities (Harris Gleckman/TNI).

This week saw the publication of the landmark revised draft of a UN treaty which aims to prevent human rights abuses by transnational corporations and other business enterprises, and close existing gaps in access to justice for victims. A coalition of 20 European civil society groups welcomes in its joint press release the publication of the revised draft UN Treaty on business and human rights and calls on the EU to conduct a thorough analysis of it. This is particularly important as the revised draft addresses many of the EU’s previous concerns, by building on the existing UN Principles on Business and Human Rights and defining which business activities should be covered. A new analysis should build the basis for a determined, proactive EU engagement in the upcoming 5th session, taking place in October 2019 in Geneva. The undersigned therefore urge the EU and its Member States to analyse the content of the revised draft and work in a transparent, inclusive process (Global Policy Forum et al).

Die Nutzung natürlicher Ressourcen überschreitet die planetaren Grenzen, die soziale Ungleichheit nimmt weiter zu und die Folgen der Klimakrise werden immer offensichtlicher. Während vor allem international agierende Unternehmen von der derzeitigen Weltwirtschaftsordnung profitieren, leiden viele Menschen weltweit unter schlechten Arbeitsbedingungen oder Umweltbelastungen. Während Handels- und Investitionsschutzabkommen Unternehmen Zugang zu Märkten und Rohstoffen sichern und ihre Interessen mit einklagbaren Rechten schützen, gibt es bis heute kein internationales Abkommen, das eine verbindliche Regulierung transnationaler Unternehmen zur Achtung von Menschenrechten oder grundlegenden Umweltstandards verlangt. Bei einer Diskussionsveranstaltung von GPF, BUND, Brot für die Welt und MISEREOR werden zivilgesellschaftliche Vertreter*innen aus Liberia, Uganda und den Philippinen, die sich gegen Menschenrechtsverletzungen und Umweltzerstörung durch multinationale Unternehmen zur Wehr setzen mit deutschen Parlamentarier*innen aus Berlin und Brüssel diskutieren, welchen Beitrag Deutschland zu einer sozial und ökologisch nachhaltigen Weltwirtschaft leisten kann und welche Rolle ein UN-Abkommen zu Wirtschaft und Menschenrechten dabei spielen könnte (Global Policy Forum et al.).

The transformation of our world as proclaimed in the title of the 2030 Agenda requires fundamental changes in the way our societies produce and consume goods and services. However, far too often, corporate profits are systematically fed by poor working conditions, low environmental standards and even by human rights abuses and violations. Instruments to prevent and hold corporations accountable for human rights abuses and the violation of social and environmental standards are weak. Against this background, the UN Human Rights Council’s resolution of 26 June 2014 establishing an open-ended intergovernmental working group to elaborate an international legally binding instrument to regulate the activities of transnational corporations. In July 2018, the Chair of the working group published a zero draft for the prospective treaty. Preventative measures, including but not limited to mandatory human rights due diligence, linked with legal liability, and the clarification and definition of the rights of affected and threatened communities will be three central elements of the prospective treaty. In a panel discussion on April 15 in New York, we will discuss how the zero draft addresses these topics (Global Policy Forum et al.).

Ein neues Briefing von Brot für die Welt, Global Policy Forum und MISEREOR zeigt auf, dass das Engagement der Wirtschaft für die SDGs und der Unternehmenseinfluss auf den SDG-Diskurs mit Risiken und Nebenwirkungen verbunden sind. Governments have dedicated a pivotal role to the private sector in the implementation and financing of the 2030 Agenda and the SDGs. This has pushed a turn towards the private sector, the promotion of multi-stakeholder partnerships between public and private actors. However, far too often there is a considerable gap between the social and environmental commitments companies make publicly in political fora like the UN and the actual effects of their production patterns and investment strategies on people and the environment. A new working paper, published by Brot für die Welt, Global Policy Forum and MISEREOR provides an overview of the ways and means by which the UN involves business actors in the debates around the implementation of the 2030 Agenda. It describes new initiatives and alliances of business actors around SDG implementation at the international level, and their main messages and policy proposals. With a few selected examples it contrasts the sustainability rhetoric of corporations with their business reality. And finally, the working paper draws conclusions and formulates recommendations for policymakers on how to increase the benefits of UN-business interactions in implementing the 2030 Agenda - and how to reduce associated risks and negative side effects (Brot für die Welt/Global Policy Forum/MISEREOR).

Die Bundesregierung zeigt kein Interesse an einem verbindlichen UN-Abkommen zu Wirtschaft und Menschenrechten, das weltweit Standards für Unternehmen setzen soll, die Menschenrechte zu wahren und die Umwelt zu schützen. So hat die Regierungskoalition die Frist zur schriftlichen Kommentierung des ersten Entwurfs für ein verbindliches UN-Abkommen zu Wirtschaft und Menschenrechten am 28. Februar dieses Jahres verstreichen lassen, ohne sich zu dem Abkommen zu positionieren. Zwar hatte sich das federführende Auswärtige Amt für eine Kommentierung ausgesprochen, konnte sich dem Vernehmen nach damit im Kabinett jedoch nicht durchsetzen. Brot für die Welt, der Bund für Umwelt und Naturschutz Deutschland (BUND), Global Policy Forum und MISEREOR kritisieren in einer gemeinsamen Pressemitteilung, dass die Bundesregierung damit ihre Blockade eines Abkommens fortsetzt, das zur Durchsetzung der Menschenrechte in globalen Wertschöpfungsketten dringend erforderlich ist (Brot für die Welt/BUND/Global Policy Forum/MISEREOR).

Laut Medien, hat das Bundesentwicklungsministerium (BMZ) einen Entwurf für ein sogenanntes Wertschöpfungskettengesetzes erarbeitet. Der Entwurf enthält ein neues Gesetz, das menschenrechtliche und umweltbezogene Sorgfaltspflichten für große Unternehmen festschreibt, so die Tageszeitung taz. Bislang setzte die Bundesregierung auf freiwillige Maßnahmen, so auch in dem Ende 2016 verabschiedeten Nationalen Aktionsplan Wirtschaft und Menschenrechte. Aktuell ist Ernst & Young damit beauftragt, die Umsetzung der menschenrechtlichen Sorgfalt durch Unternehmen in Deutschland zu überprüfen. Sollte sich bis 2020 weniger als die Hälfte großer Unternehmen zu den Menschenrechten bekennen, will die Bundesregierung gesetzlich tätig werden, so die bisherigen Pläne. Mit dem vom BMZ erarbeiteten Gesetzentwurf wird dieses Vorhaben konkretisiert. Ein solches Gesetz sollte jedoch nicht nur Sorgfaltspflichten und die entsprechenden Sanktionsmöglichkeiten festschreiben, sondern auch den Zugang zur deutschen Justiz für Betroffene von Menschenrechtsverletzungen aus dem Ausland verbessern (Global Policy Forum).

Am 26. Juni 2014 hat der Menschenrechtsrat der Vereinten Nationen (UN) die Einsetzung einer Arbeitsgruppe beschlossen, die ein rechtsverbindliches Instrument erarbeiten soll, um die Aktivitäten von transnationalen Unternehmen und anderen Unternehmen im Hinblick auf die Einhaltung von Menschenrechtsstandards zu regulieren („Treaty-Prozess“). Seither haben vier Tagungen der Arbeitsgruppe stattgefunden. Im Juli 2018 wurde von dem ecuadorianischen Vorsitz ein erster Abkommensentwurf (Zero Draft) vorgelegt, der bei der vierten Tagung der UN-Arbeitsgruppe im Oktober 2018 diskutiert wurde. Bis Ende Februar 2019 kann dieser Entwurf von den Staaten kommentiert werden. Ein neues Briefing-Papier der Treaty Alliance Deutschland diskutiert in politischen Diskussionen vorgebrachte Gegenargumente zum gesamten Prozess oder zu Inhalten des Zero Draft und formuliert Lösungsvorschläge (Global Policy Forum et al.).

A new approach, labeled “Effective Altruism” (EA) has gained traction in the debate on the impact of development aid. Unlike Aid Effectiveness, which involves donor and recipient governments, the new approach involves philanthropic institutions and their chosen (non-)governmental recipients and explores ways in which funding can be used most efficiently to have the greatest impact. Its proponents claim that their funding decisions are based on evidence-based results. However, such decisions are primarily grounded in cost-benefit considerations, neglecting social and cultural considerations and looking at problems in isolation from the wider context. From a human rights perspective, several concerns arise concerning the underlying assumptions, the methodology and the consequences of the practical application of EA. A new briefing paper, published by Global Policy Forum, Brot für die Welt and MISEREOR provides an overview of the approach underlying EA, how and by whom it is applied and its problems and consequences. It concludes that policy makers, rather than be guided by its assumptions and conclusions, must instead concentrate on understanding the confounding structural causes of interdependent global challenges and aim at their long-term solution, within an overarching human rights framework (Brot für die Welt/Global Policy Forum/MISEREOR).

Anlässlich des Weltwirtschaftsforums in Davos starten über 120 Nichtregierungsorganisationen aus Europa – so auch Global Policy Forum und u.a. das Netzwerk Gerechter Welthandel und das CorA Netzwerk für Unternehmensverantwortung – eine Petition gegen Konzernklagerechte (Investor State Dispute Settlement, ISDS) und für Unternehmensverantwortung. Damit fordern sie die EU und ihre Mitgliedstaaten auf, sich aus Handels- und Investitionsabkommen zurückziehen, die Sonderklagerechte enthalten, und künftig keine solchen Abkommen mit Sonderklagerechten mehr abzuschließen. Außerdem fordern sie, rechtliche Möglichkeiten zu schaffen, damit Konzerne für Menschenrechtsverstöße zur Rechenschaft gezogen werden können. Die Petition soll auch Druck auf die EU und ihre Mitgliedstaaten aufbauen, sich für ein UN-Abkommen zu Wirtschaft und Menschenrechten (UN Treaty) einzusetzen (Global Policy Forum et al.).

Im April 2018 forderten die Bundeskanzlerin Angela Merkel, der ghanaische Präsident Nana Addo Dankwa Akufo-Addo und die norwegische Premierministerin Erna Solberg in einem Brief den Generaldirektor der Weltgesundheitsorganisation (WHO) Tedros Adhanom Ghebreyesus dazu auf, einen Aktionsplan zur Beschleunigung der Umsetzung von Ziel 3 der Ziele für nachhaltige Entwicklung (SDGs) zu formulieren („Ein gesundes Leben für alle Menschen jeden Alters gewährleisten und ihr Wohlergehen fördern“). Die Initiierung des Prozesses für einen SDG 3-Aktionsplan stellt eine von mehreren Initiativen dar, die die Bundesregierung 2017/2018 zur Verbesserung der Globalen Gesundheit gestartet hat. Daneben begann im Juni 2018 der Prozess zur Neuformulierung der Strategie der Bundesregierung zur Globalen Gesundheit. Außerdem wurden konkrete Pläne zur Schaffung eines Global Health Hub Germany angestellt.Ein neues Briefing Paper von GPF und Brot für die Welt stellt die neu angestoßenen Prozesse und Initiativen der Bundesregierung auf nationaler und internationaler Ebene zur Umsetzung von SDG 3 und Stärkung der Globalen Gesundheit vor (Brot für die Welt/Global Policy Forum).

Wie ist das Verhältnis zwischen dem Entwurf eines verbindlichen internationalen Abkommens ("Treaty") und den bestehenden UN-Leitprinzipien für Wirtschaft und Menschenrechte? Eine Analyse des Schweizerischen Kompetenzzentrums für Menschenrechte (SKMR) stellt heraus, dass die beiden Rechtsinstrumente einander ergänzen können. Gegenwärtig diskutiert eine UN-Arbeitsgruppe die Schaffung einer neuen verbindlichen Abkommens, die menschenrechtsrelevante Aktivitäten von Unternehmen regulieren will. Die Schweiz nimmt an diesem Prozess teil. Sie vertritt die Position, dass die Arbeit an des neuen Abkommens die Weiterentwicklung und Umsetzung der bestehenden UN-Leitprinzipien zu Wirtschaft und Menschenrechten nicht beeinträchtigen darf. Vielmehr sollen die beiden Instrumente einander ergänzen. Der am 16. Juli 2018 veröffentlichte, erste Entwurf des Abkommens fokussiert auf die Prävention gegen Menschenrechtsbeeinträchtigungen durch Unternehmen: Im nationalen Recht soll eine menschenrechtliche Sorgfaltspflicht verankert werden. Ein zweiter Schwerpunkt des Abkommens betrifft die zivil- und strafrechtliche Verantwortlichkeit von Unternehmen. Die Analyse des SKMR zeigt, dass die Voraussetzungen für ein komplementäres Verhältnis der beiden Instrumente gegeben sind. Sie kommt aber auch zum Schluss, dass die Terminologie und die Kernkonzepte des Abkommensentwurfs (wie etwa die menschenrechtliche Sorgfaltspflicht) besser mit den UN-Leitprinzipien abgeglichen werden müssen. Schließlich verweist das Papier auf verschiedene Bereiche, welche innerhalb des Abkommens noch nicht kohärent geregelt oder mit bestehenden internationalen oder nationalen Regeln besser abzustimmen sind (SKMR).

In einer neuen Studie analysieren PowerShift, Brot für die Welt und MISEREOR den Rohstoff- und Energieverbrauch der deutschen Automobilindustrie und die damit verbunden Auswirkungen auf Klima, Umwelt und die Menschenrechte im Globalen Süden. Ein rascher Umstieg vom Verbrennungsmotor auf Elektromotoren ist laut Studie zwar dringend geboten, wird aber viele Nachhaltigkeitsprobleme nicht lösen. Der systematische Vorrang des Autos in Stadtplanung, Straßenverkehrsordnung und bei der Finanzierung der Infrastruktur müsse daher beendet werden. Auch für die Produktion von Akkus und Elektromotoren werden Kupfer und Stahl, aber auch Spezialmetalle wie Kobalt, Lithium, Graphit und Nickel benötigt. Deren Verbrauch wird drastisch ansteigen. Bereits 2030 könnte der Verbrauch von Lithium in Elektroautos die heutige Produktion um das Vierfache übersteigen. Auch der prognostizierte Kobaltverbrauch liegt deutlich über den derzeit geförderten Mengen. Aufgrund des überwiegend fossilen Strommix ist auch der hohe Strombedarf für Elektroautos problematisch. Selbst erneuerbare Energien seien zudem aufgrund des Flächen- und Rohstoffverbrauchs nicht unbegrenzt verfügbar. Der zusätzliche Strombedarf für Verkehr und Wärme übertrifft in Deutschland die Ausbauziele für erneuerbare Energien laut Studie um ein Vielfaches. Die Nachhaltigkeit von Stromimporten sei bisher keineswegs gewährleistet, so die Autorinnen (Brot für die Welt/MISEREOR/Powershift).

A zero draft of a legally binding instrument to regulate, in international human rights law, the activities of transnational corporations and other business enterprises, is the subject of discussions in an inter-governmental open ended working group under the auspices of the Human Rights Council (15-19 October 2018). The draft aims at harnessing international cooperation among home and host states of business enterprises in order to address barriers to get remedies for victims of human rights violations in the context of business activities of transnational character. The new policy brief by the South Centre discusses the approach to States’ role and obligations as proposed under the zero draft (South Centre).

For decades, affected communities around the globe have been resisting the modus operandi of transnational corporations (TNCs) in their territories and workplaces. Corporate impunity is embedded in and protected by an ‘architecture of impunity’ that legitimises and legalises the operations of TNCs. This architecture has been established through free trade and investment agreements, the WTO, the structural adjustment policies of the IMF, World Bank and other financial instruments and the aggressive push for public-private partnerships (PPPs). At the core of this architecture is the infamous investor-state dispute settlement (ISDS) system, a private arbitration system that allows TNCs to sue states whenever they consider that their future profits are threatened by new measures or policies aiming at improving social and environmental protection. The role of TNCs in the workings of the UN system is becoming increasingly pervasive, especially since the creation of the Global Compact and the corporate-funded UN Foundation and as can clearly be seen in the current round of negotiations on bindings obligations for TNCs at the United Nations. The new report published by Amis de la Terre France, Observatoire des multinationales (OMAL) and CETIM, examines these issues by focusing on corporate capture versus binding regulations; the question whether EU and TNCs unite against the UN Treaty; and a case study of European transnational corporations and human rights (Amis de la terre France et al.).

The European Network on National human rights institutions (ENNHRI) published a Statement on the Occasion of the 4th session of the Open-ended intergovernmental working group on transnational corporations and other business enterprises with respect to human rights (OEIGWG). ENNHRI states that "a binding treaty could make a significant contribution to addressing current governance gaps and strengthening prevention of business-related human rights abuses while also improving access to remedy for victims of such abuses, wherever they are." The National Human Rights Institutions believe a business and human rights treaty building on the UNGP’s three pillars should and can be complementary to the UNGPs. ENNHRI regrets, however, that despite positive developments and despite the growing awareness by businesses of their contribution to sustainable development, there remains insufficient progress on the part of European businesses in implementing human rights due diligence. ENNHRI also expresses concern about the continuing adverse impacts of businesses on human rights, both within and outside of Europe. Therefore, ENNHRI is convinced that there is still a great need for further efforts, including through legally binding instruments, in this area (ENNHRI).

In the new report, published by Friends of the Earth, examines EU's double agenda on globalisation regarding corporate rights and human rights. The European Union and its Member States are important actors when it comes to shaping globalisation. This briefing explores the double role the EU plays in these processes: spinning a web of treaties that give corporations extraordinary powers while hindering efforts to hold these very same companies accountable. This double agenda is exemplified by the EU’s actions in two areas: its reluctance to support binding and enforceable rights for citizens through an UN Treaty on Business and Human Rights, and at the same time expanding and entrenching a system of legally binding and enforceable investor rights and privileges that grants corporations power over governments and communities. The new report concludes that given the fundamental flaws of the investor rights system and the strong need for the UN Treaty, it is high time for the EU to review its positions on these issues and start addressing and reversing the inequities globalisation is producing (Friends of the Earth).

The Committee on Economic, Social and Cultural Rights published its concluding observations on the sixth Periodic Report of Germany on the implementation of the International Covenant on Economic, Social and Cultural Rights on October 12, 2018. In this report, the Committee especially criticizes the "voluntary nature of of the corporate due diligence obligations set out in the NAP regarding respect for human rights and the lack of monitoring mechanisms in this regard". It recommends that the State party has to "ensure the effective implementation of the NAP by all stakeholders, through a comprehensive and transparent monitoring process [...] (and) adopt a regulatory framework that ensures that all companies domiciled in the State party or under its jurisdiction identify, prevent, and address human rights abuses in their operations in not only Germany but also abroad and that they can be liable for violations". Further, Forum Menschenrechte (FMR), a network of more than 50 German NGOs, has submitted a list of issues on territorial obligations in response to he 6th Periodic Report of the Federal German Government on the implementation of the International Covenant on Economic, Social and Cultural Rights (ICESCR). FMR's list of issues on territorial obligations include 24 different problem areas resulting from the implementation of the International Covenant on Economic, Social and Cultural Rights in Germany. The observations by the Committee on Economic, Social and Cultural Rights and the list contributed by FMR once again show that Germany's voluntary measures do not tackle the problem of human rights violation and are not yet extensive enough (UN Economic and Social Council and Forum Menschenrechte).

"Between October 29th and November 2nd 2018, the members of the Working Group III of the United Nations Commission on International Trade Law (UNCITRAL) are coming together in Vienna to continue with discussions on a possible reform of the investor-to-state dispute settlement (ISDS) mechanism. The UNCITRAL process could offer an unique opportunity to thoroughly examine the widely recognised problems with ISDS and to meaningfully address its systemic imbalances. However, the process is, to a large extent, driven by the same institutions and individuals that share a common interest in the long-term survival of the system. The UNCITRAL process thus runs a real risk of producing middle-ground solutions that will fail to address the fundamental flaws of the ISDS system and will only further institutionalise and re-legitimise the system. Over the past few decades, public goods, such as water, education and health – the pillars of human rights – have increasingly been transformed into tradable commodities. Food, of course, has been traded for centuries, yet the recent failure in market regulation has led to its full commodification. As a result, it has contributed to the dispossession of productive resources. This affects peasant communities, damages the environment and changes our diets for the worse. The weak market regulatory framework has generated an ever-increasing gap between what is considered legal and what is actually sustainable and coherent with human rights. This year's 'Right to Food and Nutrition Watch' published by Global Network for the Right to Food and Nutrition explores the impacts of dematerialization, digitalization and financialization on our food systems. It discusses how these processes are altering the conception of the food market, and how food consumption habits within urban centers and beyond are being affected. It explores how targets of political action are shifting in the pursuit of food sovereignty, and interrogates how the fulfillment of the human right to adequate food and nutrition will be addressed (Global Network for the Right to Food and Nutrition).

A new report published by the Alliance for Lobbying Transparency and Ethics Regulation (ALTER-EU) examines the extreme and undue influence of big business on European Union (EU) and member state decision-making processes. It has been produced as a response to the distortions we witness in policy and law making at EU-level and across member states. It shows how corporate capture has been behind the lack of action in the aftermath of the financial crisis, with banking regulation that continues to allow mega-mergers of banks, failing to tackle the “too big to fail” problem. Similarly, the arms industry has influenced the agenda and objectives of the EU’s defence programs (ALTER-EU).

The Treaty Alliance Germany, an association of more than 20 German non-governmental organisations, has published a new statement. The Treaty Alliance Germany welcomes the draft for a UN Human Rights Treaty to regulate transnational corporations and other business enterprises with respect to human rights ("Zero Draft"). The chairmanship of the intergovernmental working group has thus created an important basis for the negotiations during the forthcoming fourth working session from 15 to 19 October 2018 in Geneva. Members of the Treaty Alliance Germany attend the 4th session and have delivered an oral statement, expressing their dissatisfaction of the fact that after three working sessions and three months after the publication of the Zero Draft, the EU and its member states are still not willing to enter discussions on the content of the treaty.This is not in line with the EU’s self-conception that human rights are core values that the EU promotes around the world. It is also not in line with Germany’s foreign policy, which regards human rights as the basic tenet (Treaty Alliance Germany).

Over the last two decades, the philanthropic sector has grown in terms of the number of foundations, the size of their annual giving, and the scope of their activities. Spending concentrates on certain selected areas, especially health, education, and nutrition. Civil society organizations, scientists, and the media have finally started to devote more attention and research to the growing influence of philanthropic foundations in global development, in particular with regard to the influential members of philanthrocapitalism. Through their grant-making, personal networking and active advocacy, large global foundations play an overwhelmingly active role in shaping the global development agenda and in setting the funding priorities for international institutions and national governments alike. A new discussion paper by Nicoletta Dentico and Karolin Seitz presents major areas of concern in particular with regard to the arena of global health and nutrition and formulates recommendations to political decision-makers (Brot für die Welt/Global Policy Forum/HIP/Medico International/MISEREOR).

Sie berät über den Entwurf für ein solches Abkommen, den der ecuadorianische Vorsitz im Juli vorgelegt hatte. To implement the 2030 Agenda many in the international community have proclaimed a need to go from “billions to trillions” of dollars. Certainly, the transformation of our world requires fundamental changes in the way our societies produce and consume goods and services. At the international level, instruments to hold corporations accountable for human rights abuses and the violation of social and environmental standards are weak. Victims of human rights violations by corporations often face insurmountable barriers to access justice. A regulation gap exists especially with regard to corporations operating transnationally. Against this background, the UN Human Rights Council’s resolution of 26 June 2014 establishing an open-ended intergovernmental working group (OEIGWG) to elaborate an international legally binding instrument to regulate within the scope of international human rights law and the activities of transnational corporations and other business enterprises deserve to be called historic. At this public event the panelists will discuss how a binding treaty could overcome obstacles for remedy in cases of cross-border human rights violations by TNCs. It will further inform about the state of the treaty process and next steps to be taken (Global Policy Forum et al.).

In 2014, following a resolution initiated by Ecuador and South Africa, the Human Rights Council of the United Nations decided by a majority vote to establish a process to create a human rights treaty to regulate business activity. Since 2015, the open-ended intergovernmental working group on transnational corporations and other business enterprises with respect to human rights has convened three times, and substantial discussion about the scope and content of the prospective treaty has taken place. It is now time to explore the possible forms of such an instrument and set out the options for the way forward in the process. Good rules and procedures can make treaty negotiations move more effectively forward and open doors to getting the best advice and text into an agreement. The substance of an agreement and the procedures to achieve that agreement are closely inter-connected. Consequently, this paper has three parts. The first and second parts look at the choice of contents and format of the agreement. The third part provides options for the institutional settings needed with regard to a bureau, the HRC Secretariat, the relationship to other UN entities and processes, and the financial questions to be solved. It also elaborates on the options for the drafting process itself with regard to the drafting of the text, the structure, and the timetable of negotiations. The third part further assesses the options for participation of civil society organizations and business (Global Policy Forum/Rosa-Luxemburg-Stiftung).


New Working Paper: The UN Foundation - A foundation for the UN?

The United Nations face a funding dilemma. On the one hand, member states continue to transfer new responsibilities to the UN system, not least in implementing the 2030 Agenda and their Sustainable Development Goals (SDGs); on the other hand, they do not match these mandates with adequate resources. Some see the way out of this financial mess in reinforced UN partnerships with private donors and their foundations. The UN Foundation (UNF) plays a special role here. It was established by US billionaire Ted Turner two decades ago principally to champion and support the work of the United Nations.The Global Policy Forum, in cooperation with the Rosa-Luxemburg-Stiftung, has taken a closer look at the work of the UNF and its special relationship with the UN in a new working paper. It describes the origins and the evolution of the UNF and its relationship with the UN. It shows that, in pursuing this aim, the Foundation appears to have developed a business model and growth strategy that primarily promote its own priorities, activities and expansion, while the direct financial support to the UN decreased significantly. The UNF’s support of the UN must also be seen in context. Ted Turner and the UNF leadership have a clear vision of the way to tackle global problems and the role the UN should play, centred solidly on public-private partnerships and multi-stakeholder approaches. The UNF has been among the driving forces behind the opening of the UN towards the business sector. The working paper examines benefits, risks and side effects of these trends, and ends with a few findings and conclusions (Global Policy Forum/Rosa-Luxemburg-Stiftung).

In 2014, following a resolution initiated by Ecuador and South Africa, the Human Rights Council of the United Nations decided by a majority vote for the establishment of a process to create a human rights treaty to regulate business activity. In 2015 and 2016 the first two sessions of the open-ended intergovernmental working group on transnational corporations and other business enterprises with respect to human rights (OEIGWG) took place, and between October 23 and 27, 2017 the working group convened for the third time. More than 100 states and 200 representatives of civil society organizations participated in the third session, during which draft elements for a treaty presented by the Chair-Rapporteur of the OEIGWG were discussed. The draft elements include suggestions on state obligations, prevention, effective remedy, jurisdiction, international co-operation, and enforcement mechanisms. Despite persistent efforts by certain states to block the process, the march towards a binding treaty will continue. The Chair-Rapporteur will now hold informal consultations on the way forward and prospectively prepare a zero draft of the treaty up to the fourth session (expected in October 2018). Governments and other actors can hand in comments on the draft elements up to the end of February 2018 (Global Policy Forum/RLS-NYC).

The new report by Greenpeace “Justice for People and Planet” demonstrates the need for urgent action to establish justice for people and planet and to end corporate capture, collusion and impunity. Through 20 case studies this report presents how corporate power has been used to repeatedly abuse and violate human and environmental rights. The cases show that corporate impunity for environmental destruction and human rights violations is a result of the current economic and legal system. State failure to protect human rights and the environment is caused by corporate capture of decision makers and state institutions, leading to the consequent refusal of politicians to implement binding frameworks and hold corporations to account. The clear failure of voluntary codes and corporate self-regulation to safeguard human rights or the environment has led to renewed public demand for binding rules. Greenpeace calls on governments to adopt 10 Principles for Corporate Accountability (Greenpeace).

Unsere Forderung an die nächste Bundesregierung: Das Kartellrecht verschärfen, um die Marktmacht von Konzernen zu begrenzen. Die Marktkonzentration ist mittlerweile so weit fortgeschritten, dass sie kleinere Unternehmen stark benachteiligt. Zulieferer, Bauern und Bäuerinnen und Arbeiter/innen in Produktionsländern können sich gegen übermächtige Unternehmen kaum durchsetzen. It is no secret that a dual relationship exists between climate change and sustainable development. The 2030 Agenda with its 17 Sustainable Development Goals (SDGs), which governments agreed in September 2015, recognizes that climate change is “one of the greatest challenges of our time” and voices concern about “its adverse impacts undermine the ability of all countries to achieve sustainable development.” In order to ensure that the implementation of the Paris Agreement truly helps foster more just and sustainable development, governments have to respect Human Rights, question the partnership and multi-stakeholder approach, reclaim policies for the public and strengthen participatory and democratic governance structures, and tackle vertical and horizontal inequalities in and between countries (Global Policy Forum).

Trade and investment protection agreements facilitate business enterprises’ access to markets and raw materials, and protect investor interests with enforceable rights. Although human rights are a cornerstone of international law, so far there are only voluntary guidelines to safeguard them within the activities of global enterprises. This needs to change; human rights need a mandatory commitment. This is where the “UN treaty process” comes in. It offers the chance for binding international regulation of global business: Since 2015, an intergovernmental working group has been negotiating an international human rights treaty that is binding for the contractual parties, outlines clear rules for business enterprises and strengthens access to justice for affected parties. The Treaty Alliance Germany - a coalition of organizations supporting such an approach - have formulated demands in a new position paper (Global Policy Forum et al.).

European NGOs call on the EU and its Member States to constructively support the negotiations around a binding treaty on business and human rights

45 European NGOs welcome the publication of the elements for a binding treaty on business and human rights which were prepared by the Chair-Rapporteur of the open-ended intergovernmental working group on transnational corporations and other business enterprises with respect to human rights on October 2nd, 2017. They urge the European Union, and its Member States individually, to use this historic opportunity to support the UN treaty and show that Europe can be a champion on multilateralism and human rights and business. The organisations call on their governments and the EU to prepare in a constructive and open spirit the European participation in the IGWG session and to discuss the draft elements with European civil society at national level and in Brussels (Global Policy Forum et al.).

More than 300 civil society organization from around the world have signed on to a letter regarding the ongoing negotiations of the WTO towards its 11th Ministerial meeting (MC11) in Buenos Aires from December 10 to 13, 2017. The organizations express increasing concern about press reports indicating that some WTO member are pushing a dangerous and inappropriate new agenda under the disgues of "e-commerce", even though there had been no consensus to introduce the issue during or since the Nairobi Ministerial of 2016. The letter also raises concerns and questions on proposals to limit the scope and effects of public interest regulation, around fishery subsidy disciplines that discourage overfishing by rich countries, agricultural rules and more (Our world is not for sale).

Das Abkommen (UN-Treaty) soll den Schutz betroffener Individuen und Gemeinschaften vor Menschenrechtsverstößen durch Unternehmen verbessern und ihnen Zugang zu Rechtsmitteln ermöglichen. Vom 23. bis 27. Oktober 2017 wird die Arbeitsgruppe zum Abkommen zum dritten Mal in Genf tagen. Die Verhandlungsleitung durch Ecuador wird bis dahin einen Vorschlag für Elemente des zukünftigen Abkommens vorlegen. In einem breiten Bündnis deutscher Nichtregierungsorganisationen, der Treaty Alliance Deutschland, hat das Global Policy Forum ein Positionspapier zum UN-Treaty-Prozess erstellt. Darin fordert es die Bundesregierung an einer konstruktiven Mitarbeit in dem Prozess auf und stellt Elemente vor, die ein zukünftiges Abkommen enthalten sollte (Global Policy Forum et al.).

The contributions to this special issue of the Global Policy Journal highlight critical issues in the study of Resourcing International Organizations (IOs), including resource diversification, the complexity of related actor constellations, and organizational differentiation that goes hand in hand with resource diversification. The findings documented in the contributions reveal how IOs seek to obtain and allocate funds, and how resourcing-related concerns pervade their organizations. Living and Working Conditions in Marikana Five Years After the Massacre

Like in Marikana, miners and communities living near mines are often confronted with severe human rights problems ranging from labour rights violations, land evictions, water and air pollution, lack of consultation and the violent shut down of protest through police and public or private security forces. Mining companies take advantage of low or inadequately enforced labour, social and environmental standards. Bench Marks Foundation has been documenting these sorts of abuses in the mining industry in South Africa and other African Countries for many years. The new publication “Platinum for the World Market, Iron Shacks for the Workers” by Brot für die Welt and Bench Marks Foundation looks at the situation in Marikana five years after the massacre of 34 workers in 2012. It illustrates that Lonmin and BASF are still far off from living up to national and international standards on responsible business conduct. The case is emblematic for the global mining industry and shows that corporate social responsibility is failing (Brot für die Welt, Bench Marks Foundation).

The Rockefeller Foundation and more recently the Bill & Melinda Gates Foundation have become influential agenda-setters in the global health and nutrition arena. How and why have U.S. mega-philanthropies played such an important role in producing and shaping knowledge, organizations, and strategies to address health issues worldwide? What are the implications for global health and its governance? Anne-Emmanuelle Birn and Judith Richter published a comprehensive article comparing and contrasting the goals, modus operandi, and agenda setting roles of both foundations. The authors conclude that the Gates Foundation’s venture-philanthropy approach underpins and is emblematic of the business models that now penetrate the global public health field. These conditions have resulted in extensive private, for-profit influence over global health activities and have blurred boundaries between public and private spheres, representing a grave threat to democratic global health governance and scientific independence (Birn & Richter).

ExxonMobil and SaudiAramco to write intergovernmental report on impacts of global warming

108 national and international environmental organizations sent a letter to the chairman of the Intergovernmental Panel on Climate Change (IPCC), to raise their concerns about the selection of authors for the special report on the impacts of global warming, which the Intergovernmental Panel on Climate Change (IPCC) will present next year. One of the selected authors (proposed by the US government) works for ExxonMobil, another for the Saudi oil company SaudiAramco. The signatories criticize that this selection does not correspond to the internal policy of the IPCC. It would actually constitute a violation of IPCC’s own conflict of interest policy (Civil Society Organizations).

CIDSE and its members launch a new study by Dr. Markus Krajewski, University of Erlangen-Nürnberg, entitled “Ensuring the Primacy of Human Rights in Trade and Investment Policies: Model clauses for a UN Treaty on transnational corporations, other businesses and human rights.” The study seeks to contribute to the debate of how a treaty on businesses and human rights might address the potential conflict between trade and investment policies and human rights in the context of the UN treaty process. It recalls the main areas of potential conflict between trade and investment policies and human rights, in particular trade and investment agreements. The study explains how some of these conflicts could be addressed in reformed trade and investment agreements. As such reforms would not be sufficient, the final part of the study develops and explains model clauses addressing investment and trade policies which could be included in a treaty on businesses and human rights (CIDSE et al.).

Dezember 2016) sollen die Leitprinzipien für Wirtschaft und Menschenrechte der Vereinten Nationen (UN Guiding Principles on Business and Human Rights, UNGPs) in nationale Maßnahmen übersetzt werden. Die neue Deutsche Nachhaltigkeitsstrategie wurde am 11. Januar 2017 vorgestellt. Sie soll den Beitrag Deutschlands zur Umsetzung der 2030-Agenda und ihrer 17 Ziele für nachhaltige Entwicklung (Sustainable Development Goals, SDGs) beschreiben. Beide Dokumente leisten potentiell wichtige Beiträge zu der Frage, wie deutsche Politik im Sinne der Nachhaltigkeitsagenda kohärent gestaltet werden kann. Bislang vollziehen sich die Diskussionen dazu in Politik und Zivilgesellschaft oft getrennt voneinander. Weltweit boomt die Gründung von privaten Stiftungen. Angesichts stagnierender öffentlicher Mittel setzen Entwicklungspolitiker ihre Hoffnung auf die Philanthropie. Auch das Bundesministerium für wirtschaftliche Zusammenarbeit und Entwicklung (BMZ) arbeitet seit einigen Jahren verstärkt mit privaten Stiftungen zusammen. Durch die Kooperation mit der Gates-Stiftung hat diese Form der Entwicklungszusammenarbeit eine neue Dimension erreicht – sowohl in quantitativer, als auch in qualitativer Hinsicht. Um die Zusammenarbeit weiter zu stärken, wollen BMZ und Gates-Stiftung Anfang 2017 ein neues Memorandum of Understanding unterzeichnen. About one week after the countries descended on Marrakech for the negotiations of the UN Framework Convention on Climate Change (UNFCCC), a new infographic by Corporate Accountability International reveals the true extent of the fossil fuel industry’s access to, and influence over, the talks. The analysis exposes the financial and membership ties between some of the world’s largest fossil fuel corporations and accredited business groups and trade associations at the UNFCCC. After several years of intense discussions and negotiations, the World Health Assembly (WHA) adopted the World Health Organization’s Framework of Engagement with non-State Actors (FENSA) on 28 May 2016. The establishment of the framework was a response to the growing concerns of many governments and civil society organizations about the corporate influence on the World Health Organization’s (WHO) normative and operational activities. The objective of the new framework was therefore to provide guidelines for clear and informed decision making on WHO’s engagement with non-State actors, and to improve transparency and accountability. FENSA constitutes a precedent. It is the first comprehensive regulatory framework within the United Nations system that covers all types of interaction with non-State actors. The new briefing paper provides an overview on the recently adopted framework. Further trade liberalisation is increasingly resisted. Much of the backlash can be viewed as a reaction to the underlying policies that, in the past, have produced many »losers« – not just »winners« – and especially have increased income inequality. Most of the »low-hanging fruit« in trade liberalisation has already been harvested. African Centre for Biodiversity (ACB) published a new report entitled “N2Africa, the Gates Foundation and legume commercialisation in Africa”. This report considers the N2Africa programme, which aims to develop and distribute improved, certified legume varieties, promote and distribute inoculants and synthetic fertiliser and develop commercial legume markets for smallholder integration in 13 countries in sub-Saharan Africa. N2Africa was started in 2009 with funding from the Bill and Melinda Gates Foundation. While ACB can recognise the potentially valuable technical and organisational contributions of such efforts, it criticizes that they currently are oriented exclusively to supporting a modernisation agenda that can only benefit few. A legume development programme that integrates farmers into seed enhancement and production, and develops appropriate quality control systems based on farmer priorities and under the control of farmers, could offer a more sustainable and inclusive approach than a private sector, profit-driven approach. The right of indigenous peoples to free, prior, and informed consent in relation to development, infrastructure, and resource extraction projects is critical to the realization of all indigenous rights connected to the preservation and control of their territories. In a legal argument regarding this right, Mónica Yriart, an attorney in constitutional law, human rights and the rights of indigenous peoples, asserts that national political powers have no intention of conceding the right of consent to indigenous peoples, and that it is now essential to trace a carefully planned, and well timed strategy, from the first step to the last, and to “accept no failure.” Especially in the light of the current conflicts around the Tía María mining project and the plans of 20 hydroelectric dams on the Marañón River in Peru, the right of indigenous peoples to free, prior and informed consent is of vital importance. In June 2014, the United Nations Human Rights Council took the historic decision to establish a working group “to elaborate an international legally binding instrument to regulate, in international human rights law, the activities of transnational corporations and other business enterprises.” This binding agreement should complement the existing UN Guiding Principles on Business and Human Rights, which show serious shortcomings. Between 24 and 28 October 2016, the second session of the working group will take place in Geneva. Agains this background, Global Policy Forum and Rosa Luxemburg Stiftung-New York Office published a new working paper. The authors challenge the attempt by UNECE to define international standards on PPPs as illegitimate and call for the issue to be raised during the upcoming FfD Forum in New York in April. The EU’s “Better Regulation” agenda, despite being less known than TTIP, seeks to improve Europe’s competitiveness by reducing the regulatory costs for business through instruments that closely resemble those discussed under TTIP. In a new report, the European Environmental Bureau, Bread for the World and Forum Umwelt & Entwicklung raise concerns over the “Better Regulation” project proposed by the Juncker Commission. According to the organizations, such a measure to curb regulation is unlikely to achieve its primary aim of improving Europe’s competitiveness. Efforts to reduce the burden of environmental regulations on business will simply subsidize Europe’s least competitive businesses by allowing them to dump part of their production costs on the environment, leaving taxpayers and citizens to pay for this through increased health care costs and efforts to clean up the environment. The “Better Regulation” agenda fails to take into consideration the benefits to society as a whole deriving from regulation. Addressing global challenges will require the EU to adopt new, effective and often legally binding policies. A blanket requirement to offset any regulatory burden arising from new policies by slashing regulatory burdens elsewhere irrespective of the benefits arising would seriously hamper these efforts. Both under TTIP and through its unilateral “Better Regulation” agenda, the EU’s governance system is changing significantly with a stronger role for well resourced regulated industries to write their own rules. A new report by Global Justice Now demonstrates that the trend to involve business in addressing poverty and inequality is central to the priorities and funding of the Bill and Melinda Gates Foundation. The authors argue that this is far from a neutral charitable strategy but instead an ideological commitment to promote neoliberal economic policies and corporate globalization. Big business is directly benefitting, in particular in the fields of agriculture and health, as a result of the foundation’s activities, despite evidence to show that business solutions are not the most effective. A new report by Corporate Europe Observatory and LobbyControl examines the origins and impacts of TTIP's proposals for regulatory cooperation and shows that the process has been dominated by big business right from the start. This part of the talks involves dismantling existing “regulatory barriers” and preventing new ones from emerging with public interest regulations having to go through lengthy procedures, including vetting by business for possible impacts on trade. A new paper by Friends of the Earth Europe explains how the European Union is aggressively pursuing special rights for businesses whilst hampering efforts to hold corporations responsible for the human rights violations they commit. The European Commission and the EU member states have been pushing for special rights for European investors whose operations are internationally enforced by secretive, business-friendly tribunals in trade agreements such as the EU-US TTIP deal. Yet, the European countries and the European Commission are derailing attempts to develop a legally binding treaty at the UN level which would give citizens the opportunity to get access to justice and defend their human rights when these are being violated by corporations. Puvan Selvanathan has resigned from the UN Working Group on Business and Human Rights, where he has been working since 2011. In an open letter to J. Rücker, current President of the Human Rights Council, Selvanathan calls for a legally-binding treaty on business and human rights. He states “I believe that if a business can operate ‘legally’ yet impact negatively on human rights then that is a simple failure of a state’s duties. […] I suggest that if states wish for businesses to respect human rights then what that constitutes must be made mandatory. […] The loudest calls within a company for higher goals are distant echoes if even a whisper for profit exists. […] Companies are our own social creations and reflect our own values. Unease over seconded philanthropic foundation staff to WHO's top management

Philanthropic foundations such as the Bill & Melinda Gates Foundation and the United Nations Foundation have seconded their staffers to top management positions at the World Health Organization. This information revealed to Member States during the ongoing negotiations of the Framework for Engagement with non-State Actors (FENSA) shows that between 2012 and 2015, WHO had 37 secondments from non-State actors (NSA). Three current top-level secondments have Gates Foundation connections. This information published for the first time brings out the lack of a comprehensive conflict of interest policy in the WHO covering both individual and institutional conflict of interest. During the negotiations, developing countries proposed a complete ban on secondments from NSAs whereas Germany and Switzerland are opposing the prohibition. WHO: Do financial contributions from ‘pharma’ violate WHO Guidelines?

Millions of dollars given by major pharmaceutical companies to the World Health Organization (WHO) raise questions of compliance with the organization’s guidelines on interactions with commercial enterprises. It is notable that the draft Framework of Engagement with Non-State Actors (FENSA) currently being finalised by WHO Member States does not contain a provision that requires a commercial enterprise to conform to WHO’s polices, norms and standard. In a new article, K M Gopakumar from Third World Network (TWN) presents the amount of financial contributions by pharmaceutical companies to the WHO and sets out why these contributions are in conflict with WHO’s criteria for ethical promotion of medicines and accordingly the Guidelines. A new GPF working paper, jointly published with Brot für die Welt and MISEREOR, examines the role and impact of philanthropic foundations in development. It addresses the impacts and side effects of philanthropic engagement by taking a closer look at the priorities and operations of two of the most prominent foundations, the Rockefeller Foundation and the Bill & Melinda Gates Foundation, in two crucial sectors, health and agriculture. So far, there has been a fairly willing belief among governments and international organizations in the positive role of philanthropy in global development. But in light of experiences in the areas of health, food, nutrition and agriculture, which are discussed in this working paper, a thorough assessment of the impacts and side effects of philanthropic engagement is necessary. Treaty debate heats up at 2015 UN business and human rights forum

In a post on the blog „Business & Human Rights in Ireland” Shane Darcy summarizes his impressions of the United Nations Business and Human Rights Forum, held in Geneva from 16 – 18 November, giving a good overview of the current state of the process. The annual event saw 2,300 attendees, representing States, business, civil society, academia and various international organisations. It also offered the chance to participate in numerous discussion panels and side events over three days touching on almost every aspect of the field of business and human rights. In regard to the initiative for a business and human right treaty the post explains several issues, including the relationship between the treaty process and the United Nations Guiding Principles, whether the treaty should be applied to transnational companies only or include national companies and the position of non-state actors in international law. Fueling the Fire: The big polluters bankrolling COP21

Corporate Accountability International has released a report about corporations sponsoring the COP21 summit next week. The report, titled “Fueling the Fire: The big polluters bankrolling COP21” analyses the track record of four major sponsors: Engie (formerly GDF Suez) and Suez Environnement, BNP Paribas and Électricité de France (EDF). It sheds light on the pollution caused by the companies as well as their greenwashing and lobbying activities and their interference with the climate summit. It concludes that there is an inherent conflict of interest in letting major polluters sponsor the COP21, and suggests regulation similar to the WHO Framework Convention on Tobacco Control to safeguard the process against conflicting interests. In an article for The Guardian, Alfred de Zayas, UN independent expert on the promotion of a democratic and equitable international order, argues that investor-state dispute settlement (ISDS) should be abolished as it puts investors rights before human rights. He outlines a number of cases in which investors sued governments over environment regulations or health standards and won, showing how commercial interests trump human rights considerations. He argues that respect for human rights must prevail over commercial laws and that it is time for the UN General Assembly to convene a world conference to put human rights at the centre of the international investment regime. Coming up to the UN climate talks in Paris bound to start next week, the Corporate Europe Observatory has taken a look at what is being cooked up by big business for the negotiations. This report highlights five “key ingredients” ranging from short-terminism, to the advocacy of fossil fuels, especially natural gas, market mechanisms, technologies that are yet to be discovered and continually promoting already existing methods such as industrial agriculture. The report concludes that the results of the Paris negotiations will offer little to the climate; however it could be an important turning point in terms of de-legitimising the dangerous and destructive role that corporate climate criminals are currently playing in climate policy-making. The 87-88 double issue of the South Bulletin titled "Business and Human Rights: Commencing discussions on legally binding instrument", which was released by the South Centre, publishes a number of detailed reports on the first meeting of the Human Rights Council's Working Group on a legally binding instrument on TNCs and other business enteprises with respect to human rights in July 2015. The reports in this Bulletin include general overviews; the scope of application of the instrument; the obligations of states and businesses; standards for legal liability and building mechanisms for access to remedy. The opening speeches of the Chairperson and a Special Rapporteur are also included.(South Centre)

In response to a 'non paper' prepared by the WHO secretariat, a number of NGOs, among them the Baby Food Action Network and the Third World Network, have sent a letter to the Director General of WHO, calling on her to protect the UN and overall policy-making from corporate takeover. The WHO 'non paper' states that the Framework of Engagement With Non State Actors (FENSA), currently under negotiation at the WHO, might have “detrimental consequences on the work of the WHO”. The NGOs undersigned on the letter are concerned, that the WHO might remain open to corporate capture and outside influences without a robust framework, which FENSA could provide. A robust framework, they argue, is essential to protect the integrity, independence and credibility of WHO as it carries out its essential norm-setting tasks.

In the recently released paper 'Foreign Direct Investment, Investment Agreements and Economic Development: Myths and Realities' by South Centre, Yilmaz Akyüz examines the effects of Foreign Direct Investment (FDI) on emerging and developing economies and how it can be used to benefit them. The paper critically assesses the benefits commonly ascribed to FDI and clarifies that only a small percentage of FDI is a long term, stable, cross-border flow of capital that adds to productive capacity, helps meet balance-of-payments shortfalls, transfers technology and management skills, and links domestic firms with wider global markets. Additionally the paper reviews the effects of the WTO and Bilateral Investment Treaties on the ability of emerging and developing economies to regulate FDI, before closing with policy recommendations derived from the analysis.

A new report released today, 'Policy prescriptions: the firepower of the EU pharmaceutical lobby and implications for public health' by Corporate Europe Observatory, probes the privileged access to decision-making in Brussels enjoyed by the pharmaceutical sector and facilitated by a lobby spending around €40 million, extensive meetings with policy-makers, and presence in advisory groups. The report reveals the dramatic extent of the pharmaceutical industry's lobbying efforts towards EU decision-makers, with the industry spending an estimated 15 times more than civil society actors working on public health or access to medicines. Under-reporting and the continued avoidance by some of the EU's voluntary lobby transparency system mean that overall industry spending may be much higher than the transparency register reveals. The prospective EU-US trade deal TTIP could be the world's biggest such treaty. While there are disagreements and divergences, in many areas of the negotiations the European Commission is singing from the corporate hymn-sheet. The revolving door between the public and private sectors is helping to grease the wheels of the TTIP corporate lobby. Some of the EU's most senior decision-makers and officials, alongside those from the member state levels, spin through the revolving door into corporate advisor roles; others go in the other direction, from corporate jobs into the public sector. Just out from the Business Sector Steering Committee is the “Financing for Development Business Compendium.” It highlights 33 efforts aimed at mobilizing the private sector capital, claiming these provide “a strong indication of the broad scope of ongoing initiatives and the potential for scaling up to achieve the demands of the Sustainable Development Goals.” The initiatives will be listed on the UN Financing for Development website as examples of the commitments different stakeholders are making under the Third International Conference on Financing for Development (FfD3). In a recently released short documentary, Brazilian initiative Justiça nos Trilhos (JnT) explains about social and environmental conflicts in iron ore extraction in the Amazon region of Carajás, northern Brazil—and the connections with the German car industry. Again and again, mining and processing of natural resources has involved violations of human rights and an escalating of violence and conflicts. Largely, this problem has lately received public attention as far as diamonds, coltan and other “conflict commodities” are concerned. However, the extraction of other commodities, such as iron, copper and bauxite, frequently also goes hand in hand with violations of human rights, severe environmental degradation, conflicts and the criminalisation of human rights defenders. Politicians and executives from some of the world’s biggest agribusiness companies are meeting in Cape Town, South Africa, on June 3, 2015, for the leadership council of the controversial New Alliance for Food Security and Nutrition. On the same day, a coalition of a hundred farmers’ organisations, social movements, unions and civil society groups around the world have released a statement calling on the G7 and African governments to stop supporting the New Alliance. The policies of the New Alliance have been criticised as they “facilitate the grabbing of land and other natural resources, further marginalize small-scale producers, and undermine the right to adequate food and nutrition.” (Africa Euorope Faith and Justice Network)

New Call for an International Legal Framework on Business and Human Rights

In June 2014, the UN Human Rights Council adopted Resolution 26/9 to establish an Intergovernmental Working Group (IGWG) whose mandate shall be to elaborate an international legally-binding instrument to regulate the activities of transnational corporations and other business enterprises with respect to human rights. Ahead of the upcoming first session of the IGWG on 6-10 July 2015, the Treaty Alliance, a coalition of more than 610 NGOs and 400 individuals across the globe, calls on all civil society organizations and States to actively and constructively participate in this process. The new Treaty Alliance joint statement calls for signatures to demand strong regulation of corporate human rights abuses, new strong systems of remedy for affected people and no undue corporate interference in the treaty-making process. The right of indigenous peoples to free, prior, and informed consent in relation to development, infrastructure, and resource extraction projects is critical to the realization of all indigenous rights connected to the preservation and control of their territories. In a legal argument regarding this right, Mónica Yriart, an attorney who specializes in constitutional law, human rights and the rights of indigenous peoples, asserts that national political powers have no intention of conceding the right of consent to indigenous peoples, and that it is now essential to trace a carefully planned, and well timed strategy, from the first step to the last, and to “accept no failure.”

WHO: Work on non-State actors engagement framework to continue

The recently concluded 68th World Health Assembly (WHA) adopted a resolution to continue the negotiations on WHO’s Framework for Engagement with Non-State Actors. The seven days of hectic negotiation, which started on 20 May could not reach consensus on critical issues due to the divergence of views among Member States. These issues include the definition of resources, secondments, the relation of WHO with industries other than the tobacco and arms industry, transparency requirements, oversight mechanism of engagements with non-State actors (NSAs), ceiling on financial resources, and others. The advocates for enhanced engagement with NSAs are developed countries and this was viewed by developing countries as an attempt to facilitate corporate capture of the WHO. (Third World Network)

At the sixty-eighth World Health Assembly, the currently discussed Framework of Engagement with Non-State Actors (FENSA) is one major topic of concern. Member States have not yet reached a consensus about the main subjects of debate. These are the determination of rules of engagement between WHO and non-State actors (NSAs), secondments from the private sector, and restrictions and/or ceilings on financial contributions from NSAs. While there are conflicts of interest within entities across the public and private sectors, vigilance is needed to ensure that the private sector cannot drive technical recommendations and policy-making. During the sixty-eighth World Health Assembly, which is held in Geneva 18-26 May 2015, the WHO member states restarted negotiations on a framework for engagement with non-state actors. The current draft framework aims to open up official relations to non-state actors, including NGOs, the private sector, philanthropic foundations and academic institutions. Furthermore, certain rich member states are seeking to force WHO to open up its policy-making and decision-making spaces to transnational corporations. Many states have raised concerns about conflicts of interest, as well as on the credibility, integrity and independence of the WHO. The report documents sample cases of serious violations of internationally established norms and standards. It investigates 25 controversial companies that in 2013 had a joint revenue of approx. €4.196 trillion and achieved net profits of €450 billion. Companies that have been selected include some that are blacklisted on investors exclusion lists, others that do not comply with international or national law, or those that face serious allegations by the media or civil society. Dirty Profits 3 also investigates the extent to which these companies are supported by European financial institutions.

A new report released at COP20 by Corporate Europe Observatory, Democracy Center and Transnational Institute shows how corporations causing social and environmental destruction in the Andes and Amazon are driving climate change, whilst enjoying influential seats at the climate-negotiating table. The case studies included demonstrate how corporations from the global North operating in the extractives industry use well-honed practices of political manipulation while hiding their true nature through extravagant public relations campaigns which trumpet their disingenuous environmental credentials. The consequences of these corporations’ manipulation of decision-making processes include: the opening of new gas fields that destroy indigenous territories, the decimation of local water supplies and the forced displacement of whole communities. Yet in the midst of such exploitation the writers of the report have also witnessed brave acts of resistance by local communities.

A July Report from the World Bank’s Independent Evaluation Group (IEG) has revealed a worrying lack of proven poverty impact from the World Bank’s public-private partnerships (PPPs). This comes despite a significant increase in the Bank’s support to PPPs in the decade 2002 through 2012 and the Bank’s recent strategy, which suggests intensifying support for PPPs in the future. One key reason for the ineffectiveness of PPPs, writes Eurodad's María José Romero, has been the scant attention paid to hidden debts run up by these partnerships. Indeed, public sector liabilities triggered by PPPs can be substantial and this has been the case for many PPPs. If this particular issue is not addressed properly, it has the potential to have long-term negative development impacts. Overall, the IEG evaluation raises critical points that should prompt deep reflection and a management response from the World Bank Group, including a reassessment of the rationale for supporting PPPs to reduce poverty and fight inequality.

G8 New Alliance for Food Security and Nutrition Not Supportive of Small-Scale Food Producers

On the occasion of the meeting of the Leadership Council of the New Alliance for Food Security in New York, ninety-one civil society organizations from G7/8 member countries have signed a joint statement expressing their strong criticism of the New Alliance initiative. The organizations are demanding that governments of the G7/8 take immediate action to radically reform the New Alliance, citing how changes in agricultural policy and legislation under the New Alliance continue to benefit commercial concerns to the detriment of small-scale farmers. German organizations, in turn, are calling on the German Federal Government to use its Presidency of the G7/8 in 2015 to propose an alternative initiative that focuses on the interests of small-scale farmers in the Global South and supports their contribution to food security through public investment. In a recent press release, Corporate Europe Observatory highlights the consensus of trade unions and transparency organizations around ‘the need to tackle the persistent over-representation of corporate interests in the European Commission “expert groups”’. Research shows that the dominance of business interests in the most economically and politically powerful expert groups can often have a detrimental effect on the EU decision making process – indeed corporate interests are seldom in line with public interests. While everybody on both sides of the Atlantic seems to be talking about TTIP when it comes to discussing free trade theses days, another currently negotiated agreement looms in the shadows: Like a steamroller, the Trade in Services Agreement (TISA) could flatten almost every sphere of services. Under the pretext of circumventing the stalemated Doha Round of the WTO, Switzerland and 50 other mostly industrialized countries are negotiating a broad-based agreement for financial services, telecommunications, internet trade, transport by water, land and air, professional services (lawyers, architects, doctors, etc.), and energy and postal services. TISA aims to embed deregulation in national legal systems such that – once introduced – there is no going back. Shadowy institutions take over development agenda through private company support

Eurodad publishes a new report dealing with the relationship between development finance institutions (DFIs) and the private sector. Government-controlled DFIs are important players in the development arena through investing in the private sector in development countries. As the report points out, these institutions are organized as private, profit-oriented corporations facilitating an imbalance in power structures. This means that rich country governments are able to influence DFIs through shareholding, while not including recipient countries in their investment decisions. This, according to Eurodad, could be circumvented by, inter alia compliance with finance standards and a greater development focus of DFIs. (Eurodad)

In a recent policy paper, the FIAN critically analyses the G8 “New Alliance for Food Security and Nutrition in Africa” from a human rights perspective. Although the G8 initiative intends to get 50 million people out of poverty by 2022, according to FIAN, serious concerns about the initiative have to be raised. It ignores general human rights principles and does not carry out human risk analysis. Besides, the G8 New Alliance links the opining of agriculture and food markets to foreign investors with fighting hunger and malnutrition. While the G8 initiative enforces its public-private partnership initiative, FIAN calls on G8 governments to stop it, because of its bias towards the corporate sector and the missing states’ obligations to ensure no violations of human rights through private corporations. Resolution on binding human rights standards passes in Human Rights Council

The Treaty Alliance published a Press Release on the adoption of a resolution initiating a process to develop legally binding human rights standards for transnational corporations. The resolution sponsored by Ecuador and South Africa was adopted on June 26 by the United Nations Human Rights Council after fierce negotiations. Chanel, Tupperware to accelerate women's empowerment

UN Women launches a new Private Sector Leadership Advisory Council. The council, which is expected to offer advice to accelerate women's economic empowerment, end violence against women and help to close the funding gap for UN Women, is comprised of ten corporate executives from companies ranging from Tupperware to Chanel to Anglo American. The council is supposed to provide the foundation for further "Golden Triangle" partnerships, as they are being called, between corporations, governments and civil society. G20/OECD plans for global tax reform dominated by corporate interests

On May 2 Oxfam released the report ‘Business among Friends’ critically assessing the OECD-led ‘Action Plan on Base Erosion and Profit Shifting’ (BEPS). The negative implications of tax evasion and profit shifting for development are increasingly acknowledged among political leaders and international organizations. The amount that governments in the Global South lose annually due to illicit financial transfers but also legal means of tax evasion easily outnumbers the amount they receive in form of Official Development Aid (ODA). Nevertheless, developing countries are not involved in the process of reforming the global tax system, according to the authors. Instead, business interests dominate the negotiations. As a result, OECD members and multinational corporations will likely benefit from BEPS at the expense of developing countries. (Oxfam)

This paper analyzes the relationship of the World Health Organisation (WHO) with the private sector. It provides a historical perspective on corporate influence on the WHO, particularly the increase in public-private partnerships and product development partnerships presided over by Gro Harlem Brundland, during her tenure as WHO Director-General from 1998 to 2003. By 2012-2013, the paper illustrates, more than 80 per cent of the WHO Programme Budget — US$ 3.9 billion — comes from voluntary contributions from the private sector, rather than regular quotas from Member States. With World Water Day on March 22nd drawing close, former water advisor to the General Assembly Maude Barlow cautions against the growing influence of the private sector in water related matters within the UN. Through participation in the World Water Development Report and the CEO Water Mandate of the UN Global Compact, water conglomerates are able to exert greater influence on global water policies. This contradicts the 2010 UN recognition of the human right to water and sanitation. Without Rules: A Failed Approach to Corporate Accountability

Reports on human rights violations by corporations operating globally raise concerns about the effectiveness of existing oversight measures. Human Rights Watch argues that voluntary approaches are inadequate as they encourage ad-hoc actions against human rights violations by both corporation and government, advocating for enforceable standards and greater government oversight. States where companies are based are responsible for safeguarding extra-territorial human rights, particularly when the host country government lacks the necessary capacity to scrutinize operations. While the 2012 UN Guiding Principles on Business and Human Rights raise good options, the principles themselves are less ambitious than other human rights standards and do not require mandatory commitments. Anti-bribery approaches employed by the UN and OECD and increasing corporate disclosure are good starting points for improving corporate accountability. (Human Rights Watch)

This Reuters’ report sheds light on the increasing influence of the private sector in policy-making at the World Health Organization. WHO now promotes "industry-led self-regulation" as an alternative to legal standard-setting. Leading food and beverage corporations participate in the decision-making of WHO’s approach to nutrition and Coca-Cola, Nestle, and Unilever largely fund projects and conferences. Not to mention that some WHO advisers have strong ties to the industry. Such association is particularly visible in Mexico, the country with both the world’s highest rate of obese adults and the highest consumption of Coca-Cola. While the UN promotes corporate responsibility by championing its Global Compact, this “partnership” with the industry raises serious concerns about the ability of the organization to remain impartial and impervious. As the United States and eight Pacific Rim nations are negotiating the Trans-Pacific Partnership (TPP) free trade agreement in San Diego, critics are saying that TPP is mainly about new corporate rights, not trade. The negotiations and their texts are open only to government negotiators and a selected group of about 600 corporate lobbyists. Through such secretive process, the officials in charge of the TPP can ensure the completion of controversial clauses such as financial deregulation in the Pacific Rim and establishment of corporate tribunals which permit transnational corporations to overrule local courts and other government agencies in disputes. Revealed – the capitalist network that runs the world

The idea that a few transnational corporations (TNCs) control the global economy might not seem like news to the Occupy Wall Street movement. But now, an analysis by the Swiss Federal Institute of Technology in Zurich empirically identified such a network of power. By combining the mathematics long used to model natural systems with comprehensive corporate data to map ownership among 43,000 of the world's TNCs, the study reveals that a relatively small group of TNCs, mainly banks, control almost 80% of the global economy. As the world learned in 2008, the tight interconnections between the most powerful global players results in a highly unstable system. If one company suffers distress, this propagates. Towards an International Tribunal on Economic Crimes

Voluntary codes of conduct are not enough to stop large transnational corporations from abusing the environment and human rights. Crimes committed by TNCs often go unpunished since the concept of economic crimes has no international legal definition. To get past this problem, the Enlazando Alternativas network calls for the creation of an international tribunal on economic crimes. The network wants this sort of abuse labeled as "crimes against humanity." Though small steps are being made towards an international tribunal of this kind, the pace is painfully slow and so far, TNCs optional good-will rarely gets priority over profit. Controlling Transnational Corporations

According to the UN, most global trade is controlled by a few hundred corporations. Many of these mega-corporations are economically larger than some nations and thus it is difficult for developing countries to regulate them. Since the United State is home to many of the world's largest TNCs, stronger regulation in the US is key in enforcing international standards that promote the social and economic rights of those in developing countries. One of the steps towards controlling TNCs is for the United States to ratify UN and ILO conventions that promulgate labor rights and consumer protection. (FPIF)
